These Terms of Service apply when you visit helenwooldridgeart.com or purchase a product from Helen Wooldridge Art. Please read them before placing an order.
1. About us
This website is operated by Helen Wooldridge, trading as Helen Wooldridge Art, a sole trader based in England.

In these terms, “we”, “us” and “our” mean Helen Wooldridge Art. “You” and “your” mean the customer or website visitor.
2. These terms and your statutory rights
These terms, our Returns and Refunds Policy and our Privacy Policy apply to your use of the website and purchases from us.
Nothing in these terms limits your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or other rights that cannot legally be excluded.
If there is an inconsistency between these terms and the Returns and Refunds Policy about a cancellation, return or refund, the provision that gives the consumer the greater legal protection will apply.
3. Our products
We sell original artwork, fine art prints, canvas prints, framed prints, greetings cards and, where offered, commissioned or personalised artwork.
We take reasonable care to describe and photograph products accurately. However:

Colours may look slightly different on different screens.

Room images and mock-ups are illustrative and may not show exact scale.

You should use the measurements in the product description to assess size.

Frames, mounts and accessories are included only where expressly stated.

Original artworks may contain handmade marks, textures and variations that form part of the work.

Minor variations caused by screen settings, handmade framing or normal production tolerances may not be faults, provided the product remains as described and of satisfactory quality.
4. Placing and accepting an order
When you place an order, you offer to buy the selected product under these terms. An automated acknowledgement confirms that we have received the order but does not necessarily mean that it has been accepted.
The contract between us is formed when we send an order confirmation accepting your order.
We may decline or cancel an order before dispatch if:

A product is unavailable or an original has already been sold.

There is an obvious error in the price or description.

Payment cannot be authorised.

We cannot deliver to the address supplied.

We reasonably suspect fraud, misuse or unlawful activity.
If we cancel an order after taking payment, we will issue a full refund.
5. Original artworks
Original artworks are one-off products and are subject to availability. An original may occasionally sell through another channel before the website has been updated. If this happens, we will let you know and issue a full refund.
The product description will state the dimensions, materials and whether an original is framed. A certificate of authenticity is included only where stated or supplied with the artwork.
6. Prints, canvases and framed prints
Standard fine art prints, canvas prints and framed prints may be manufactured and dispatched by our fulfilment partner, Printumo, after an order is placed.
Choosing from the standard artwork, size and frame options offered on the website does not, by itself, make the product personalised or remove a UK consumer’s statutory cancellation right.
Printumo may process the customer’s name, delivery address and necessary order information to produce and deliver the product. We remain the seller and your point of contact for the order.
Printumo’s operational process provides a free replacement or full refund, where appropriate, for a product that arrives damaged, has a manufacturing defect or is incorrectly supplied, when supported by the required photographs and reported within 30 days where possible. Full details are in our Returns and Refunds Policy.
Printumo’s internal processes do not reduce your statutory rights against Helen Wooldridge Art.
7. Commissions and personalised products
Before starting a commission, we will agree the principal details with you, including the brief, dimensions, price, payment schedule and estimated completion time.
We may also agree a deposit, approval stages, included revisions and cancellation arrangements. These additional agreed terms will form part of the contract.
Original artwork is created by hand. We cannot guarantee an exact copy of another artwork, photograph, mock-up or reference image, and reasonable artistic discretion will apply.
The statutory change-of-mind cancellation right does not normally apply to commissioned, clearly personalised or genuinely bespoke products made to your individual specifications. Your rights still apply if a product is faulty, damaged or not as agreed.
Unless agreed otherwise in writing, copyright and reproduction rights in commissioned artwork remain with Helen Wooldridge.
8. Prices and payment
Prices are displayed in the currency selected on the website. The total price, applicable taxes and delivery charges will be shown before you complete checkout.
Payment must be made using a method offered at checkout. Payments are processed by third-party payment providers, and we do not receive your complete card details.
If an obvious pricing error is discovered before dispatch, we will contact you. You may confirm the order at the correct price or cancel it for a full refund.
9. Delivery
Available destinations, delivery charges and estimated delivery times are shown on the website or during checkout.
Production and delivery times are estimates unless we expressly agree a guaranteed date. Unless another period has been agreed, we will deliver within 30 days after the order is accepted.
Please provide a complete and accurate delivery address. If a parcel is returned because an incorrect or incomplete address was supplied, delivery was refused or it was not collected, we may charge the reasonable cost of sending it again.
If delivery is materially delayed by circumstances outside our reasonable control, we will contact you and explain your options. Your statutory rights concerning late or failed delivery are unaffected.
Responsibility for the product passes to you when it is delivered to you, or to a person you have identified to receive it. You own the product once we have received payment in full.
For international orders, you are responsible for customs duties, import taxes and local charges imposed by the destination country, unless stated otherwise at checkout.
10. Cancellations, returns, damage and refunds
Our Returns and Refunds Policy explains:

The 14-day statutory cancellation period for eligible online orders.

The Returns and Refunds Policy forms part of these terms. Nothing in either document limits your statutory rights.
11. Promotions and discount codes
Unless a promotion states otherwise, discount codes:

Must be used before their expiry date.

Cannot be exchanged for cash.

Cannot be combined with another offer.

May apply only to selected products.

Must be entered at checkout and cannot be applied retrospectively.
We may amend or withdraw a promotion, but this will not affect an order we have already accepted. Purchasing a discounted product does not remove statutory cancellation or faulty-goods rights.
12. Copyright and intellectual property
All artwork, images, photographs, text, branding, designs and other original content on the website belong to Helen Wooldridge Art or are used with permission. They are protected by copyright and other intellectual property laws.
Buying an original artwork, print, canvas, card or commission transfers ownership of the physical product only. It does not transfer copyright or reproduction rights.
Without prior written permission, you must not copy, scan, reproduce, publish, distribute, alter, license, sell, use commercially or create products from our artwork or website content.
We may photograph and reproduce commissioned artwork for our portfolio, website, social media, prints and promotion unless we agree otherwise with you in writing. We will handle any associated personal information in accordance with our Privacy Policy.
13. Reviews and material you provide
If you submit a review, photograph or other content for publication, you confirm that you have the right to provide it and that it is not unlawful, misleading, abusive or infringing.
Where you give permission for publication, you grant us a non-exclusive, royalty-free right to display and reproduce that material for the agreed purpose. We will obtain appropriate permission before using identifiable customer photographs for unrelated marketing.
We may remove submitted content where reasonably necessary.
14. Acceptable website use
You must use the website lawfully. You must not:

Interfere with its security or operation.

Introduce viruses or harmful technology.

Attempt unauthorised access to the website, accounts or data.

Use automated methods to extract content without permission.

Copy or commercially exploit website content.

Provide false, misleading or fraudulent information.
We may update, suspend or withdraw parts of the website. We do not guarantee that it will always be available or completely free from errors.
15. Third-party services and links
We use third parties for services such as website hosting, payments, production, fulfilment, delivery, analytics and marketing. We remain responsible for performing our contract with you where those providers act on our behalf.
The website may link to unrelated third-party websites. We are not responsible for their content, availability or practices.
16. Personal information and cookies
We collect and use personal information in accordance with our Privacy Policy.
Information about cookies and similar technologies is included in that policy and in the cookie and privacy controls available on the website. Where UK law requires consent for optional analytics or advertising cookies, you can accept, reject or change your choices through those controls.
17. Our responsibility to you
We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for:

Loss or damage that was not reasonably foreseeable when the contract was formed.

Loss caused by inaccurate information you supplied.

Business losses where you purchased wholly or mainly for business purposes.

A delay or failure caused by circumstances outside our reasonable control, although this does not affect statutory rights concerning delivery or refunds.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing limits your statutory consumer rights.
18. Changes to these terms
We may update these terms to reflect changes to the website, our business or the law. The terms applying to an order are those published when the order is placed. The current version will show its last updated date.
19. If part of these terms is invalid
If a court or relevant authority decides that part of these terms is unlawful or unenforceable, the remaining provisions will continue to apply.
20. No waiver
If we do not immediately enforce a provision of these terms, this does not prevent us from enforcing it later.
21. Governing law and courts
These terms and contracts between us are governed by the law of England and Wales.
If you are a consumer, you may bring court proceedings in England and Wales or, if you live elsewhere in the United Kingdom, in the courts where you live. You also retain any mandatory consumer protection provided by the law of the country in which you live.
